General Terms and Conditions*

1) Scope

These General Terms and Conditions (GTC) govern the contractual relationship between Princess Sophie Yacht Charter GmbH (hereinafter referred to as the “Provider”) and the charter customer (hereinafter referred to as the “Customer”).

2) Subject Matter of the Contract

The provider makes the yacht “Princess Sophie”—including the agreed-upon equipment and skipper—available to the customer for use during the contractually specified period.

3) Conclusion of the Contract

A contract is formed by:

  • a written booking confirmation
  • or payment of a deposit

4) Prices and Payment Terms

  • Deposit: 50% upon booking
  • Balance due: no later than 30 days before the charter begins
  • Last-minute bookings: 100% immediately

5) Security Deposit

The customer provides a security deposit of €3,000 (credit card authorization), which serves as protection against damage.

6) Pickup and Return

  • The vessel will be handed over in seaworthy condition and cleaned
  • Return in the same condition
  • Any damage must be reported immediately

7) Customer Obligations

The customer agrees to:

  • to use the yacht properly
  • to comply with all legal regulations
  • to employ only qualified skippers (unless chartered without a skipper, in which case an exception applies)
  • to maintain accurate crew lists (unless chartered without a skipper, in which case an exception applies)

8) Liability

The customer is liable for:

  • any damage caused by the customer or their crew
  • loss or damage to equipment

Liability is limited to cases of willful misconduct and gross negligence on the part of the provider.

9) Insurance

The yacht is insured.

The following, in particular, are not covered:

  • gross negligence
  • intentional damage
  • personal belongings

10) Withdrawal / Cancellation

Cancellation fees:

  • Up to 60 days: 50%
  • Up to 30 days: 70%
  • Less than 30 days: 90%

11) Force Majeure

In cases such as:

  • storms
  • War
  • Government restrictions

there is no entitlement to compensation.

12) Jurisdiction and Governing Law

Swiss law applies. The place of jurisdiction is St. Gallen.
